General terms and conditions of sale of products sold on Ma Petite Corée

Article 1 - Purpose

These terms govern sales by the company MPC TRADES / 엠피씨 트래이드 321-2 Itaewon-dong, Yongsan-gu, Seoul 04357 

 

Article 2 - Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping fees.

In case of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and amounts are not the responsibility of the company MPC TRADES / 엠피씨 트래이드. They will be your responsibility and are entirely your responsibility, both in terms of declarations and payments to the authorities and competent bodies of your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of origin, are payable in euros.

The company MPC TRADES / 엠피씨 트래이드 reserves the right to change its prices at any time, but the product will be billed based on the rate in effect at the time the order is confirmed and subject to availability. The products remain the property of the company MPC TRADES / 엠피씨 트래이드 until full payment of the price. Warning: as soon as you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

 

Article 3 - Orders

The company MPC TRADES / 엠피씨 트래이드 reserves the right not to record a payment and not to confirm an order for any reason whatsoever, particularly in case of supply problems or difficulties concerning the received order.


Article 4 - Validation of your order

Any order placed on the website https://mapetitecoree.com/ implies acceptance of these General Conditions. Any order confirmation entails your full and unconditional acceptance of these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation will serve as proof of the transaction. You declare that you have full knowledge of it. The order confirmation will be considered as signature and acceptance of the operations carried out. A summary of your order information and these General Conditions will be sent to you in PDF format via the order confirmation email address.

 

Article 5 - Payment

Validating your order implies your obligation to pay the indicated price. Payment for your purchases is made by credit card through a secure system. The card is only charged at the time of shipment of the order. In case of split deliveries, only the shipped products are charged.

 

Article 6 - Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, returns must be made in their original and complete condition (packaging, accessories, manual). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may invalidate the right of withdrawal. Return costs are your responsibility. In case of exercising the right of withdrawal, the company MPC TRADES / 엠피씨 트래이드 will refund the amounts paid within 14 days following the notification of your request and via the same payment method used during the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: The provision of services fully performed before the end of the withdrawal period and whose execution began after the consumer's prior express consent and express waiver of their right of withdrawal. The provision of goods or services whose price depends on fluctuations in the financial market beyond the professional's control and likely to occur during the withdrawal period. The provision of goods which, after delivery and by their nature, are inseparably mixed with other items; The provision of alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at the conclusion of the contract depends on fluctuations in the market beyond the professional's control. The provision of audio or video recordings or computer software when they have been unsealed by the consumer after delivery. The provision of a newspaper, periodical, or magazine, except for subscription contracts to these publications. Transactions concluded at a public auction. The provision of digital content not supplied on a tangible medium whose execution has begun after the consumer's prior express consent and express waiver of their right of withdrawal. Article 7- Availability

 Our products are offered as long as they are visible on the site https://mapetitecoree.com/ and within the limits of available stock. For products not stocked, our offers are valid subject to availability from our suppliers. In case of product unavailability after placing your order, we will contact you as soon as possible to propose either: a replacement product, or a full refund of the unavailable product. Furthermore, the website https://mapetitecoree.com/ is not intended to sell its products in large quantities. Therefore, the company MPC TRADES / 엠피씨 트래이드 reserves the right to refuse orders for identical items.


Article 8 - Delivery

Products are delivered to the delivery address provided during the ordering process, within the timeframe indicated on the order confirmation page. 

The delivery times indicated on the order confirmation page are indicative and do not include the order processing time and correspond to the transport time after shipment.

The order preparation time is generally 2 to 4 business days.
However, this period may be extended in certain situations, especially during high demand periods (Christmas, Black Friday, Korean national holidays) or for highly sought-after products (lightsticks for concert dates, promotional items).

Delivery methods offered:

-K-Packet: transport up to 14 business days after shipment, without signature.

-DHL: transport up to 5 business days after shipment, with signature.

In case of exceeding the maximum legal period of 30 days (preparation + transport), we will contact the customer to offer a full refund or obtain their agreement for a delayed shipment (with compensation if necessary).

In accordance with legal provisions, the company MPC TRADES / 엠피씨 트래이드 cannot be held responsible for delivery delays caused exclusively by the customer's unavailability after several appointment proposals.

Delivery tracking: When the packages are shipped, you will receive a confirmation email from our carrier as well as from MPC TRADES / 엠피씨 트래이드 indicating the tracking number and the expected delivery date. It is the customer's responsibility to track the shipment of their package using this information.

We invite you to regularly monitor the tracking and to contact our carrier directly if you wish to change the delivery address or the delivery time. Consequently, MPC TRADES / 엠피씨 트래이드 cannot be held responsible for the lack of notification regarding the delivery status or any situation related to the package, without prior request from the customer to the carrier or our services.

Return: In case the package is returned to our Seoul offices, we will contact the customer to offer two options. The first option is a refund of the product, excluding initial shipping fees, from which return fees will be deducted, especially if the return is due to an error attributable to the customer (incorrect or incomplete address, failure to collect the package, or any other reason within their responsibility). The second option is reshipment of the package, subject to prior payment of new shipping fees as well as the incurred return fees.

Defective products: In case of a damaged product or delivery error, it may, at the customer's choice, be refunded or reshipped. This guarantee applies exclusively to the product itself and does not cover packaging (boxes, wrapping, and aesthetic elements), except in cases of damage making the product unusable.

Delivery is not available to certain countries (e.g., Spain, Mexico, Portugal, Italy) due to customs reasons.
If delivery is impossible, the order will be canceled and fully refunded.

Customs: Please note that Ma Petite Corée is not responsible for any customs fees that may be applied by the local authorities in your country. 

Additionally, shipments with DHL may be subject to random inspections that can result in customs fees or delays. DHL may request proof of payment, which we will provide upon request. Any delays or additional fees related to customs are not the responsibility of Ma Petite Corée.

💡 All customs fees are beyond our control and remain the buyer's responsibility. No refunds can be made for applied fees.  

Article 9 - Delivery Issues

Package marked as delivered but not received
For K-Packet shipments, La Poste does not allow claims if the package is marked as delivered.
The customer must first contact La Poste to verify the location of the package. If La Poste cannot provide explanations regarding the location of the package, the customer must request a document certifying non-receipt, send it to us, along with a sworn statement written by the customer accompanied by an identity document. Without these documents, no refund can be granted.


Damaged package
Any claim must be made by email with a photo of the damaged package and the unusable product is mandatory. 


Incorrect address
If the package is returned due to an incorrect address:

Option 1: Refund of the item excluding shipping and return costs.

Option 2: Reshipment to a new address, shipping costs borne by the customer.

Article 10 - Warranty

All our products benefit from the legal warranty of conformity and the warranty against hidden defects, as provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned, exchanged, or refunded. All claims, exchange, or refund requests must be made within 30 days of delivery.

Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, manual...). Shipping costs will be reimbursed based on the charged rate, and return costs will be reimbursed upon presentation of receipts. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided in Article 6.

Article 11 - Liability

The responsibility of the company MPC TRADES / 엠피씨 트래이드 cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.

Furthermore, the company MPC TRADES / 엠피씨 트래이드 cannot be held responsible for damages resulting from improper use of the purchased product. Finally, the responsibility of the company MPC TRADES / 엠피씨 트래이드 cannot be engaged for any inconveniences or damages inherent to the use of the Internet network, including service interruptions, external intrusions, or the presence of computer viruses.

 

Article 12 - Applicable Law in Case of Disputes

The language of this contract is French. These terms of sale are subject to French law. In case of dispute, French courts will have exclusive jurisdiction.

 

Article 13 - Intellectual Property

All elements of the site https://mapetitecoree.com/ are and remain the intellectual and exclusive property of the company MPC TRADES / 엠피씨 트래이드. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written agreement of the company MPC TRADES / 엠피씨 트래이드. Article 13 - Personal Data The company MPC TRADES / 엠피씨 트래이드 reserves the right to collect personal information and data concerning you. They are necessary for managing your order, as well as improving the services and information we provide to you. They may also be transmitted to companies involved in these relationships, such as those responsible for executing services and orders for their management, execution, processing, and payment. This information and data are also kept for security purposes, to comply with legal and regulatory obligations. In accordance with the law of January 6, 1978, you have the right to access, rectify, and object to personal information and data concerning you, directly on the website.

Article 14 - Archiving Evidence

The company MPC TRADES / 엠피씨 트래이드 will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized records of the company MPC TRADES / 엠피씨 트래이드 will be considered by all parties involved as proof of communications, orders, payments, and transactions between the parties.

Les commandes peuvent prendre entre 1 et 4 jours ouvrés avant d’être expédiées. Vous recevrez un e-mail de confirmation d’expédition dès que votre commande sera prête.

Si votre colis vient tout juste d’être expédié avec K Post, il faut attendre que la poste coréenne collecte le colis. Les informations de suivi sont généralement disponibles 1 jour après l’expédition.

Vous pouvez vérifier votre colis directement sur le site du service postal local.

  • Si le suivi ne montre aucune mise à jour ou si votre colis semble perdu, contactez d’abord la poste locale pour vérifier.
  • Si après 14 jours le colis n’a toujours pas été reçu, contactez-nous afin que nous puissions ouvrir une enquête avec la poste coréenne. Merci de nous fournir une preuve que vous avez essayé de contacter la poste locale, de préférence.

Nous faisons tout notre possible pour que votre commande vous parvienne rapidement et en toute sécurité

Si votre colis KPacket semble bloqué avant 14 jours, nous vous recommandons de patienter un peu. Vous pouvez également contacter le service postal local pour obtenir plus d’informations sur votre colis.

Si votre colis a été expédié via DHL, contactez DHL dans votre pays pour vérifier le suivi. Ensuite, contactez-nous afin que nous puissions contacter DHL Corée pour résoudre le problème rapidement.

Nous faisons tout notre possible pour que vos commandes vous parviennent dans les meilleurs délais !

Pour DHL, la livraison prend généralement 3 à 5 jours ouvrés après l’expédition du colis et dès que vous avez reçu la notification d’envoi, et non pas à partir de la date de commande. Nous faisons tout notre possible pour expédier vos commandes le plus rapidement possible.

Si votre colis est marqué « livré » sur le site de votre service postal local (La Poste en France, DHL en Allemagne, Royal Mail au Royaume-Uni, etc.), vous devez contacter votre bureau de poste local pour savoir où se trouve votre colis. Il se peut que le colis ait été remis à un voisin, laissé dans un point de dépôt proche, ou encore retenu par le facteur pour une raison quelconque.

Si votre bureau de poste ne peut pas localiser le colis, revenez vers nous afin que nous trouvions une solution ensemble.

Nous vous recommandons de demander une preuve écrite de votre contact avec la poste pour faciliter toute procédure de remboursement si nécessaire.

Avant expédition, contactez-nous dès que possible avec votre nouvelle adresse afin que nous puissions la mettre à jour à temps.

Une fois le colis expédié via K-Packet, nous ne pouvons pas modifier l’adresse. Vous devez contacter votre bureau de poste local pour voir s’il est possible de récupérer ou rediriger le colis.

Si votre colis est expédié via DHLcontactez-nous dès que possible pour que nous tentions de mettre à jour l’adresse avant l’expédition.
